These terms govern the purchase of artworks through Farinha Rosa, operated by Pedro Farinha (Tax ID / NIF 217285317) and Ana Rosa (Tax ID / NIF 211858277), Caldas da Rainha, Portugal, contact info@farinharosa.com.
The website functions as a catalogue, with no automatic checkout: each purchase is negotiated and confirmed directly by email or other direct contact, after the customer expresses interest in a specific artwork.
Each sale corresponds to a work identified on its own product page (technique, dimensions, price and photographs). The price shown is final, but is always confirmed in writing before the purchase is completed, together with the shipping cost, calculated case by case according to destination and the dimensions of the artwork.
The price shown in the catalogue is the final retail price, including VAT at the reduced rate of 6% (Article 15 of Decree-Law No. 199/96). For customers registered for VAT in another EU Member State, the transaction may be invoiced VAT-exempt under intra-Community supply rules, upon valid proof of VAT number and of transport out of national territory. For customers outside the EU, the sale is treated as an export and may be invoiced VAT-free upon appropriate customs documentation; customs duties, import taxes or local fees at destination are the customer's responsibility.
Payment is made by bank transfer or another agreed method, after order confirmation and before shipping; bank details are provided to the customer at that time.
Preparation and shipping typically take ten days, plus carrier transit time; shipments outside the EU may be subject to additional customs delays, the costs and formalities of which are the customer's responsibility.
Delivered artworks correspond to the description, photographs and information on the respective product page, with a legal guarantee of conformity and absence of hidden defects under Portuguese law. The right of withdrawal and the terms for returns and refunds are governed by the Refund Policy and Right of Withdrawal, available in the site footer, and do not apply to custom-made works produced to the customer's specifications.
For an invoice with specific tax details (name, tax ID, address), these must be provided before payment is confirmed, via info@farinharosa.com.
These terms are governed by Portuguese law. In the event of a dispute, and without prejudice to consumer protection rules that may confer jurisdiction on a different court, the competent court is that of the consumer's place of residence or, failing that, the court with jurisdiction under general rules.
Complaints Book and Alternative Dispute Resolution
Consumers may use the Complaints Book, available physically at the studio, or the Electronic Complaints Book at www.livroreclamacoes.pt.
Under Law No. 144/2015 of 8 September, customers are informed that, in the event of a consumer dispute, the competent alternative dispute resolution entity is CNIACC — Centro Nacional de Informação e Arbitragem de Conflitos de Consumo, Rua D.
